A Few Examples Of Our Previous Work

Here are a few of our previous judgements we’ve won for our clients:

Breach of contract trial, Hempstead, Waller County, Texas.

Jury verdict in favor of our client (plaintiff), publicly-traded cooler manufacturer, for nearly $1 million in damages, over a contract for the manufacture of a large industrial machine where an email account was hacked and payments were misappropriated by hackers and defendant refused to deliver the machine.

Obtained summary judgment (dismissal of all claims) on behalf of a 501(c)(3) non-profit organization based on an alleged failure to permit former employees to participate in a retirement plan. Plaintiffs sought in excess of $300,000 in damages.

Employee Retirement Income Security Act (ERISA) case, U.S. District Court for the Northern District of Texas, Dallas Division

Fraud, negligent misrepresentation, and tortious interference with contract case, Austin, Travis County, Texas.

Obtained non-suit of all claims against clients after filing Motion to Dismiss under Texas anti-SLAPP statute. Plaintiff alleged damages in excess of $1 million.

Non-compete, non-solicitation, tortious interference, and sexual harassment case, Houston, Harris County, Texas.

Plaintiff demanded more than $900,000 in damages, settled at mediation, without any compensation to Plaintiff.

Overseas government contractor case, United States District Court for Eastern District of Texas, Texarkana Division.

Obtained summary judgment on behalf of international government contractor based on alleged traumatic brain injury suffered by plaintiff in Marine-vehicle outfitting/upgrading facility in Kuwait. Plaintiff claimed more than $1 million in damages.

Products death case, Fort Worth, Tarrant County, Texas.

Won summary judgment against subrogation claim brought by life insurance company on behalf of decedent’s widow. Subrogation carrier refused to lower settlement demand from $290,000, the full amount of its purported damages, at mediation. Summary judgement granted against all claims by subrogation carrier after hearing only one week after mediation, fully disposing of insurance carrier’s $290,000 claim.

Product liability death case, Houston, Harris County, Texas.

Reached settlement of less than $5,000 on behalf of a dealer of industrial trailers alleged to have caused Plaintiff’s death by electrocution.

Automotive Product liability trial, United States District Court for the Northern District of Texas, Dallas Division.

Obtained directed verdict for automobile manufacturer in crashworthiness case.

Automotive Product Liability Appeal, U.S. Court of Appeals for the Fifth Circuit.

Briefing resulted in affirmation of trial court’s directed verdict based on lack of cost-benefit analysis of novel alternative design proposed by Plaintiff’s expert.

Engineering negligence case, U.S. District Court for the Eastern District of Michigan, Ann Arbor Division.

Six-month trial resulting in hung jury in high profile toxic tort.

Contractor vs. non-paying customer, District Court in Collin County.

Obtained judgment on behalf of contractor who provided labor and materials for repairs to non-paying residential customer. Judgment covered balance owed as well as attorneys’ fees, court costs and interest.  In post-judgment, we were able to collect 100% of the judgment awarded.

Construction company vs. former employees not abiding by non-compete, District Court in Dallas County.

Obtained permanent injunction on behalf of construction company against former employees who, in total disregard of their non-compete clause, had started a competing business targeting the same region of customers.

Friends turned foes in jointly owned property dispute, District Court in Dallas County.

Obtained trial verdict and final judgment on behalf of individual who owned property with a friend.  Both had agreed to sell the property but, after funds were expended and the sale in process, the friend reneged on their agreement.  Final judgment included damages, attorneys’ fees, court costs as well as pre- and post-judgment interest, totaling over $135,000.

Defeated a Motion to Dismiss under the TCPA. 

Dallas District Court,  Dallas County.   Plaintiff, our client, sued his former employer after he was terminated because employer sent email to all its  employees stating that Plaintiff had  been terminated for substance abuse.  Defendant  filed motion to dismiss under the TCPA alleging that it had a  duty to inform its employees under the freedom of speech provision of the TCPA.  Defendant also argued  that the TCPA preempted the federal drug testing guidelines.   We argued that the TCPA was  not applicable and that the TCPA did not preempt the federal guidelines.  The court agreed and held that the TCPA was  not applicable in this case.

EEOC

Successfully represented a former employee who alleged discrimination based on age and other factors.  We argued that the statistical  data showed an adverse impact on older workers affected by the  alleged reduction in force.  We  also presented evidence that a much younger employee was promoted to the same position from which the former employee was terminated allegedly due to the reduction in force.

Breach of Contract case related to foreclosure sale gone wrong, Texas Judicial District Court, Denton County

Successfully overturned incorrect trial court ruling dismissing case via Rule 248 of the Texas Rules of Civil Procedure at the appellate court level allowing breach of contract claims to proceed to trial. The Texas Supreme Court confirmed this decision by denying the petition for review.

Professional Negligence Case in Galveston, Texas

Represented engineering company in breach of contract case. Prepared briefing in First Court of Appeals and successfully obtained an order of dismissal of claims against engineering company for Plaintiff’s noncompliance with statutory filing requirements.

Negligence Case in Comal County, Texas 

Represented solar panel company in personal injury case involving alleged negligent installation and repair of solar panels. Obtained summary judgment on all claims alleged against the company.

Negligence/Trespass Case in Young County, Texas

Represented homeowners in litigation for trespassing and destruction of trees on property. Obtained favorable settlement of over a quarter million dollars.

Product Liability in Waller County, Texas

 

Represented product manufacturer in personal injury case involving an ice chest cooler. Plaintiff asserted design and manufacturing defect claims and demanded over one million dollars. Prepared discovery and engaged in negotiations which led to favorable settlement below six figures.
